These Terms of Use ("Terms") govern the Pelana website and, when available, the Pelana mobile application and related services. Pelana is operated by Adrianto Dwitomo (publicly known as Adri Dwitomo), an individual based in Singapore ("Pelana", "we", "us", or "our").
Please read these Terms before using Pelana. By using the website or app, you agree to these Terms. If you do not agree, do not use Pelana.
Current website status: This website offers a free early-access waitlist and support contact. It does not sell or activate a subscription. The app, purchase, and gameplay provisions below apply only if and when the mobile app is available to you and you use those features.
1. App Store licence and these Terms
When released, Pelana is intended to be distributed through Apple's App Store. Unless Pelana separately provides a custom end-user licence agreement through Apple, the Apple Standard End User License Agreement (Standard EULA) governs the licence to the iOS application.
These Terms govern Pelana-specific features and services, including personal-finance tools, Pela, Private AI, the Quest Card subscription, Adventure progression, and support.
If these Terms conflict with mandatory App Store purchase rules or non-waivable consumer law, those mandatory rules or laws control to the extent of the conflict.
Apple is not responsible for Pelana's support or Pelana-specific services except to the extent stated in Apple's applicable terms.
2. Who may use Pelana
You must be at least 13 and legally permitted to use Pelana where you live. If you are below the age at which you can enter a binding agreement or consent independently to relevant data processing, you may use Pelana only with the involvement and permission of a parent or legal guardian as required by law.
Pelana is not intended to be used in violation of sanctions, export restrictions, or other applicable law.
3. What Pelana is
Pelana is a personal-finance organisation, tracking, planning, educational, and gamified motivation tool. Features may include:
- local transaction and account tracking;
- budgets, goals, schedules, and planning tools;
- Pela, a money companion;
- optional on-device Private AI;
- XP, Adventure progression, quests, and Adventure Coins; and
- paid Quest Card / Pelana subscription features.
Pelana is designed to help you understand and organise information you provide. It does not hold, custody, transfer, or invest your money.
4. Pelana is not financial, legal, tax, or professional advice
Pelana is not a bank, broker, investment adviser, lender, credit bureau, accountant, tax adviser, lawyer, fiduciary, or financial planner, and Pelana does not provide regulated financial services merely by displaying or organising your information.
Any budget suggestion, category, forecast, goal, AI response, spending observation, "safe to spend" amount, or similar output is for general informational and organisational purposes. It may be incomplete, delayed, or wrong.
You are responsible for checking important amounts, dates, categories, balances, tax consequences, and financial decisions against reliable records or a qualified professional.
Do not rely on Pelana as the sole basis for investment, tax, credit, legal, emergency, or other high-stakes decisions.
5. Your information and responsibility for accuracy
You control the information you enter into Pelana. You are responsible for making sure you have the right to enter, import, or process it.
Pelana may infer a category, amount, merchant, date, currency, or other field from natural-language input. You should review information that matters to you. Automatic or quick-entry features may save information without a separate confirmation screen when the product clearly presents that behaviour.
You remain responsible for your financial records and for correcting errors you notice.
6. Local storage, exports, and backups
Pelana is designed as a local-first application. Your financial records and much of your Pelana activity may exist only on your device unless you intentionally export or back them up.
You understand that local data can be lost if, for example, you:
- delete Pelana or its local data;
- lose, damage, erase, or replace your device without a usable backup;
- lose an encryption or backup passphrase that Pelana does not possess; or
- overwrite or delete an exported backup.
Pelana will use reasonable care in the app's storage and migration logic, but you should maintain appropriate backups for information that is important to you.
If Pelana provides a user-controlled encrypted backup whose passphrase is not transmitted to us, we cannot recover a forgotten passphrase or decrypt that backup for you.
7. Pela and Private AI
Pela may use an optional AI model that runs on supported devices. AI-generated responses can be inaccurate, incomplete, inconsistent, or unexpected.
You should not treat AI output as a guarantee or as professional advice. Verify important facts and financial figures yourself.
Downloading or running a local model may use substantial storage, memory, battery, and device resources. Model availability and compatibility can vary by device and operating-system version.
Pelana may update, replace, or discontinue a particular local model for security, compatibility, licensing, quality, or availability reasons, while seeking to preserve the functionality promised by an active paid subscription where applicable.
8. Quest Card / subscription terms
Pelana may require an active Quest Card / Pelana subscription entitlement to access the main paid experience after any eligible trial or introductory period.
Purchase and renewal
Subscriptions are purchased through Apple's in-app purchase system. The actual product name, subscription period, local price, taxes where applicable, trial or introductory offer, and renewal information shown in the Pelana purchase screen and Apple's purchase sheet are part of the offer presented to you.
An auto-renewable subscription renews automatically for the applicable subscription period unless you cancel before renewal through your Apple Account, subject to Apple's rules and applicable law.
Trials and introductory offers
A free trial or introductory offer is available only when Apple considers your account eligible for that offer. If an eligible free trial is shown and you start it, the subscription converts to the displayed paid subscription when the trial ends unless you cancel in time through Apple.
Pelana will not intentionally represent you as eligible for a free trial when the store reports that you are not eligible.
Billing and payment information
Apple processes the payment. Pelana does not receive your full payment-card details.
Prices can vary by country or region and may change in accordance with Apple's subscription rules. Where Apple or applicable law requires consent to a price change, the required process applies.
Cancellation and management
You can manage or cancel an App Store subscription through your Apple Account subscription settings. Deleting Pelana from your device does not cancel the subscription.
Restore purchases
Pelana provides a purchase-restore mechanism for eligible App Store purchases. Restored access depends on the entitlement information returned by Apple and the purchase infrastructure used by Pelana.
Refunds
Refund requests for App Store purchases are generally handled by Apple, subject to Apple's policies and your mandatory rights under applicable law.
When paid access ends
When a paid entitlement expires or is cancelled at the end of its paid period, the current release pauses access to the main app. Cancellation or expiry does not automatically erase your local Pelana data. In-app correction, export, and deletion surfaces may be unavailable while access is paused; privacy requests can still be sent to the contact address in these Terms.
9. Adventure Coins, XP, quests, and game progression
Adventure Coins, XP, levels, quests, cosmetic rewards, and similar Pelana game elements are digital features used inside Pelana.
Unless Pelana expressly states otherwise in a legally valid offer:
- they are not legal tender, cryptocurrency, stored value, or a financial account;
- they have no cash value;
- they cannot be withdrawn, redeemed for money, or transferred to another person;
- they do not represent ownership of Pelana or any asset; and
- they are not a gambling stake or real-money prize.
Pelana may correct game balances or progression that were created by a software bug, duplicated transaction, exploit, tampering, or other unauthorised manipulation. We will not intentionally remove legitimately earned progression merely to avoid providing promised paid value.
10. Acceptable use
You may use Pelana only for lawful, personal purposes and in accordance with these Terms.
You must not intentionally or knowingly:
- use Pelana to commit, facilitate, conceal, or promote fraud or other unlawful activity;
- access, collect, enter, or disclose another person's private information without authority or a lawful basis;
- probe, attack, disable, overload, disrupt, or compromise Pelana, its distribution, support systems, or a third-party service used by Pelana;
- distribute malware, malicious code, destructive payloads, or content intended to compromise a device or service;
- bypass, forge, manipulate, or interfere with subscription entitlements, purchase validation, paywalls, security controls, data-protection controls, reward idempotency, XP, Adventure Coins, or other integrity mechanisms;
- exploit a bug to obtain duplicate rewards, paid access, or other benefits and continue doing so after you know it is unintended;
- impersonate another person or misrepresent your authority;
- scrape, automate, reverse engineer, decompile, disassemble, or derive source code except to the extent expressly permitted by applicable law or applicable open-source licences;
- remove or alter proprietary notices; or
- use Pelana in a way that infringes another person's intellectual-property, privacy, or other legal rights.
Nothing in these Terms prohibits lawful interoperability, fair dealing/fair use, or security research that cannot lawfully be restricted. Good-faith security researchers should avoid accessing other people's data, avoid service disruption, and report material vulnerabilities responsibly to adri@pelana.app.
11. Protecting Pelana against abuse
We may take proportionate steps to protect Pelana, users, service providers, and the integrity of purchases or rewards if we reasonably detect malicious activity, fraud, exploitation, security threats, or a material breach of these Terms.
Those steps may include refusing a suspicious operation, correcting an exploit-created balance, limiting developer-operated services or support, requiring an app update, or reporting conduct where legally required.
We will not use this clause to override non-waivable consumer rights or to keep payment for a service we are legally required to refund.
12. Intellectual property
Pelana, Pela, the Quest Card, Pelana's visual identity, illustrations, game assets, original copy, software, interfaces, trademarks, and other Pelana materials are owned by or licensed to Adrianto Dwitomo and are protected by applicable intellectual-property law.
The licence you receive to the iOS application is governed by the applicable Apple EULA and these Terms. No ownership of Pelana intellectual property is transferred to you.
You retain rights you already have in the information and content you enter into Pelana. Because Pelana is local-first, we do not need a broad licence to your local financial data. If you voluntarily send content to support, you give us a limited licence to use that content only as reasonably necessary to respond, investigate the issue, secure Pelana, and meet legal obligations.
Third-party and open-source components remain subject to their respective licences.
13. Third-party services
Pelana uses or may interact with third-party services such as Apple, RevenueCat, and model-delivery infrastructure. Their terms, availability, and privacy practices may also apply to your use of those services.
We are not responsible for an independent third party's acts, outages, account decisions, or content to the extent the issue is outside our reasonable control, but this does not limit any responsibility Pelana has under mandatory law for its own conduct or choice of providers.
14. Updates, compatibility, and availability
We may update Pelana to fix bugs, improve security, maintain compatibility, change local models, or improve features. Some updates may be required to continue using Pelana safely or to maintain access to developer-operated services.
We may modify or discontinue features for legitimate product, security, legal, licensing, or technical reasons. For material changes to paid functionality, we will comply with applicable subscription and consumer-protection obligations and, where appropriate, provide reasonable notice.
We do not guarantee that Pelana will work forever on every device, operating-system version, or third-party service.
15. Suspension and termination
You may stop using Pelana at any time. Removing the app does not automatically cancel an Apple subscription; cancellation must be managed through Apple.
Your licence rights may terminate if you materially violate the applicable EULA or these Terms, subject to applicable law. Where reasonably possible, Pelana will use proportionate measures rather than terminating ordinary users for minor or accidental issues.
If paid access is materially affected by a suspension attributable to us rather than your serious breach, any refund or remedy will be handled as required by Apple and applicable law.
16. Disclaimers
To the maximum extent permitted by applicable law, Pelana is provided on an "as is" and "as available" basis.
We do not warrant that:
- every financial entry, category, forecast, calculation, AI response, or game event will be error-free;
- Pelana will always be uninterrupted or available;
- every device will support every feature; or
- local data can always be recovered after device loss, deletion, corruption, or loss of an unrecoverable backup passphrase.
These disclaimers do not exclude warranties or statutory rights that cannot legally be excluded.
17. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability where applicable for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
To the maximum extent permitted by law, Adrianto Dwitomo will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of profits, opportunity, goodwill, or data, arising from Pelana where such losses were not reasonably foreseeable or were outside our reasonable control.
To the maximum extent a monetary cap is permitted by law, our aggregate liability arising from Pelana or these Terms will not exceed the greater of:
- the amount you paid for Pelana subscriptions during the 12 months before the event giving rise to the claim; or
- US$100 (or local-currency equivalent).
This cap does not apply where applicable law does not allow it.
18. Responsibility for intentional misuse
To the extent permitted by law, you are responsible for losses and third-party claims that result directly from your intentional or reckless unlawful use of Pelana, your intentional infringement of another person's rights, or malicious tampering with Pelana's systems or purchase/reward integrity.
Where applicable law permits an indemnity, you agree to indemnify and hold Adrianto Dwitomo harmless from reasonable third-party claims, damages, and costs arising directly from that conduct.
This clause does not make you responsible for claims caused by Pelana's own breach, negligence, defective software, or conduct for which liability cannot legally be shifted to you.
19. Consumer rights
You may have mandatory rights under the laws where you live. Nothing in these Terms is intended to waive, restrict, or replace rights that cannot legally be waived, including rights relating to digital services, unfair contract terms, refunds, privacy, or defective products/services.
If a provision of these Terms conflicts with mandatory consumer law, the mandatory law applies and the remainder of the Terms continues to the extent legally possible.
20. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules, except that mandatory consumer protections and mandatory rights to bring claims in your home jurisdiction remain unaffected where applicable.
Before starting formal proceedings, you and Pelana are encouraged to contact each other and make a reasonable good-faith effort to resolve the issue informally.
Nothing in these Terms requires arbitration or waives a class, collective, or court right unless a separate legally valid agreement expressly says so.
21. Changes to these Terms
We may update these Terms for legal, security, operational, or product reasons. For material changes, we will provide reasonable notice where required or appropriate and update the effective date.
If applicable law requires affirmative consent to a change, we will request that consent. A change will not retroactively take away paid rights or mandatory consumer rights.
